Layaway Agreement
This is the agreement you will sign. Please read it before you start your plan.
When you receive the agreement form
We will email you the payment agreement form after your first payment has been made. Print it, fill it in, sign and date it by hand, and send us a clear photo of the signed pages, by replying to our email or uploading it on your plan page.
Payment reminders: you will receive an email 3 days before each scheduled payment date, with the amount due and how to pay.
Seller & Customer
The seller is HRT AUTO SHOP, 3798 Bowling St SW, Cedar Rapids, IA 52404, United States. The seller agrees to hold the engine you chose (the "Merchandise") for you under the terms of this layaway plan. The total purchase price includes applicable taxes and fees.
Layaway payment terms
- Down payment (non-refundable): 15%, 20% or 30% of the total purchase price, paid first.
- Remaining balance: paid weekly, biweekly or monthly, over 2 to 6 months, on the schedule you choose.
- Price lock guarantee: the total purchase price is locked for six (6) months from the date of the agreement. If the layaway period exceeds six (6) months, the seller reserves the right to adjust the price based on current market rates and material costs.
Production & shipment
- Build commencement: for custom or rebuilt engines, the seller starts the build process only after 80% of the total purchase price has been received.
- Final delivery: the Merchandise is released for shipment or pickup only after the total purchase price has been received in full.
- Storage: when the engine build is complete, you have sixty (60) days to pay any remaining balance. If you do not, storage fees of $70.00 per day may apply.
Cancellation & default
- Non-refundable deposits: all deposits and payments made under this layaway plan are non-refundable.
- Late fee: a late fee of $130.00 may be charged if a scheduled payment is more than five (5) days overdue.
- Default: if a scheduled payment is missed for more than thirty (30) consecutive days, the agreement is in default.
- Restocking fee: on default or if you cancel, the seller keeps the down payment and any later payments as a restocking fee and liquidated damages for removing the Merchandise from active inventory.
90-day limited warranty
The seller provides a ninety (90) day limited warranty from the date of delivery, covering the internal mechanical components of the engine.
- Coverage: defects in materials or workmanship under normal use and professional installation.
- Exclusions: improper installation, misuse, racing, overheating, lack of maintenance, or damage from external components.
- Claims: all claims must be submitted in writing within the warranty period. The seller may inspect, repair or replace the unit at its sole discretion.
Governing law & acknowledgment
This agreement is governed by the laws of the State of Iowa. By signing the agreement form, you confirm that you have read, understood and agreed to its terms and conditions.
